New Delhi: A Kerala-based Hindu organisation, Sree Narayana Manava Dharmam Trust, has filed a petition in the Supreme Court challenging the Waqf (Amendment) Act, 2025. The trust claims that the amended law threatens the economic and religious foundation of the Muslim community in India.
Why the Trust Filed the Petition
The trust, which promotes the teachings of social reformer Sree Narayana Guru, said it could not remain silent while the new law harms a large section of society. The petition argues that the amended law could:
- Destroy the Waqf system, which has supported Islamic religious and charitable practices for centuries.
- Replace Islamic law with government control, treating Waqf properties as non-religious assets.
- Violate key constitutional rights such as religious freedom and cultural identity (Articles 21, 25, 26, and 29).
According to the plea, the law would result in the loss of financial and economic independence for the Muslim community, making it difficult for them to sustain religious practices and institutions.
What’s Happening in Court
The Supreme Court will hear the matter today at 2 PM. The case will be taken up by a bench including Chief Justice Sanjiv Khanna, Justice PV Sanjay Kumar, and Justice KV Viswanathan.
The Court has stopped the filing of new petitions in the matter. However, organisations or individuals wanting to join the case can file intervention applications.
Trust’s Legal Stand
Filed by advocate Vaibhav Choudhary and drafted by legal expert Dr. G Mohan Gopal, the petition describes the new law as:
- Unconstitutional
- Beyond the powers of Parliament
- A “fraud on the Constitution“
The trust believes the law could dismantle the economic foundation of the Muslim community, calling it a serious threat to their existence in India.
